A fee agreement is signed and fees are charged on an hourly basis, except for certain procedures such as debt recovery, drafting of non-judicial documents and contracts, and insolvency proceedings, for which a flat-rate fee applies.
Setting of fees based solely on the outcome of the case is prohibited.
An agreement on additional fees, supplementary to payment for the service provided and calculated on the basis of the results obtained or the service rendered, is lawful.
Areas of law
General commercial litigation
The law practice deals with all pre-litigation and litigation related to the business activities and commercial relations of companies, and any issues concerning the negotiation and performance of contracts, the sale of products or services, as well as restrictive practices and unfair competition.
The law practice provides its services within the framework of litigation over distribution rights, particularly on cases involving termination of business relations, breach of non-compete clauses, or hiring away of employees for example. Other matters may include disputes between a principal and sales agents or any other intermediary.
The law practice is active in all areas of transport law – land, sea, inland waterways – particularly for transport operators and their insurers. It handles all aspects of carriage of goods and passengers by road, and the operation of ships or boats, etc.
Industrial risks and product liability
The law practice is competent in matters of industrial risk and product liability. It assists industrial firms and/or their insurers with applications for judicial appraisal (summary and main proceedings), judicial appraisal procedures and any post-appraisal litigation in court.
The law practice provides assistance to creditors in particular, by managing relations with the parties involved in the proceedings and the court: safeguarding creditor rights, preparing and negotiating employment protection and recovery plans and analysing risks generated by the insolvency proceedings.
The law practice assesses the legal risks of a claim and manages claims, both during the judicial appraisal and in court, or within the framework of amicable negotiations. It particularly provides assistance in the area of third-party liability (professional, operating or defective product liability, etc.).
Labour law disputes
The law practice defends its clients' interests in labour disputes before the labour tribunals but also in administrative courts where protected employees are involved, or in penal courts, in cases of harassment or concealed labour for example.
Debt recovery in France
The law practice provides responsive and cost-effective debt recovery management, in all areas and for all amounts. Our activity covers every step in effective debt recovery: notice to pay, interim payment award or motion for injunction to pay, and enforcement.
Enforcement of foreign decisions in France
The law practice manages all aspects of enforcing decisions handed down by foreign courts (in or outside the EU) on the French territory, particularly to take the necessary measures to protect (conservatory measures) or enforce (compulsory enforcement) rights arising from the decision made abroad.
Termination of contractual relationships
The law practice defends its clients' interests in the event of termination of contractual relationships. This extensive field encompasses numerous cases including breakdown of talks, breach of contract (particularly distribution or sales agency agreements), and sudden termination of established business relations (Article L. 442 -6-I of the French Commercial Code).
